The following agreement forms the Premium Membership at Your Poetry Dot Com
You must agree to this prior to requesting this membership type.
Your Poetry Dot Com provides its Premium Membership service to you, subject to the following terms and conditions. Your Poetry Dot Com Premium Membership may be updated by us from time to time without notice to you. You can review the most current version of this agreement anytime at: http://www.your-poetry.com/premmembership_agreement.php.
Currently, the (non-refundable) fee for this service is $30.00(us) per year, paid in advance.
Your Poetry Dot Com has provided this Premium Membership Service which allows the ability to access otherwise "off limits" features such as; edit and delete; extra poetry areas, banner free surfing of the site, and other features as they are implemented. You understand and agree that this Service is provided "AS-IS" and that Your Poetry Dot Com assumes no responsibility for losses of transmissions, data, or any failures to store any communications, poetry or personal settings.
By continuing you hereby agree that:
(1) You are of or above the "Legal" age in your country (18 or 21) to be considered an adult. If you are not above this age, you MUST have your parents read, understand, and accept this agreement on your behalf.
(2) You provide true, accurate and current information about yourself (such information being your profile) and
(3) You maintain and promptly update your profile to keep it true, accurate and current.
(4) You observe the site rules and abide by them at all times.
If you provide any information that is untrue, inaccurate, or not current, or Your Poetry Dot Com has reasonable grounds to suspect that such information is untrue, inaccurate or not current, Your Poetry Dot Com has the right to suspend or terminate your Premium Membership Account and refuse any and all current or future use (or any portion thereof).
Your Poetry Dot Com is concerned about the safety and privacy of all its users, particularly children. Remember, children will need their parents' permission to become a member of this section, and parents must remember that this section could expose your children to poetry containing bad language (swearing, cursing etc.) and poetry of a suggestive or erotic nature.
You acknowledge that Your Poetry Dot Com does not pre-screen Premium Members, but that Your Poetry Dot Com shall have the right, in their sole discretion to refuse, suspend, move or delete any Premium Member that either and/or:
(1) Breaks the site rules purposefully or regularly.
(2) Attempts to submit poetry and/or other comments, forum posts, etc. to the GENERAL POETRY SECTION that contains any of the following: vulgar language; racist remarks; sexual descriptions, erotica, or other words or verse, which, in the opinion of our editors is not suitable for general exhibition.
(3) Transmits or sends, in any form; hate, obscene, or racist messages to any other members of this site.
(4) Causes defamation of any one or otherwise violate any law or right of anyone whether a member of this site or not.
(5) Has been suspended, moved, or deleted previously from this site.
(6) Attempts to; or hacks into any other members' accounts, or any part of this, or any other website.
(7) Attempts to Edit their poetry to add any words or verse, that are in violation of the site rules.
If your Premium Membership is suspended, moved, or deleted for breach of the site rules, or breach of this agreement; you understand that Your Poetry Dot Com shall not be required to refund any or all of your membership fees.
The Member warrants to Your Poetry Dot Com that they are the sole owner and copyright holder of the Material they posted, and that they do not violate or misappropriate any "Trademarks", copyrights or other intellectual property rights of anyone.
You agree that by submitting your poetry to this site, you give Puttock International Pty. Ltd (the owners and operators of YOUR POETRY DOT COM), the right to publish your poem on the web on this site, and to distribute your poem from time to time for web site promotion or email specials and to quote your poem. Remember, all credit and copyright for the poem will remain with the author.
You shall indemnify and hold harmless, Your Poetry Dot Com, its employees, agents, affiliates and owners from any claim or demand, including reasonable legal fees, made by anyone due to or arising out of your membership profile, any post to or transmissions through this YPDCPM service, your use of and connection to the YPDCPM service, or your violation of any rights of any other person, service or entity.
Your Poetry Dot Com reserves the right at any time; and from time to time, to modify or discontinue, temporarily or permanently, this service (or any part thereof); with or without notice. You agree that Your Poetry Dot Com shall not be liable to you or to any third party for any modification, suspension or discontinuance of the this service.
You expressly understand and agree that:
Your use of the service is at your sole risk. The Premium Membership is provided in an "as is" and "as available" basis. Your Poetry Dot Com, disclaims all warranties of any kind, whether express or implied, including, but not limited to the implied warranties of merchantability, fitness for a particular purpose and non-infringement.
Your Poetry Dot Com makes no warranty that:
(1) The service will meet your requirements,
(2) The service will be uninterrupted, on-time, secure, or error-free,
(3) The results that may be obtained from the use of the service will be accurate or reliable.
No advice or information, whether oral or written, obtained by you from Your Poetry Dot Com or through or from this service shall create any warranty not expressly stated in the service.
Limitations
You understand and agree that Your Poetry Cot Com, its employees, agents, affiliates or owners shall not be liable for any direct, indirect, incidental, special, consequential or exemplary damages, including but not limited to, damages for loss of profits, goodwill, use, data or other intangible losses; even if Your Poetry Dot Com has been advised of the possibility of such damages; resulting from:
(1) The use of or the inability to use this service;
(2) The cost of obtaining substitute goods and services resulting from any goods, data, information or arts purchased or obtained or messages received or transactions entered into through or from this service;
(3) Unauthorized access to or alteration of your transmissions or data;
(4) Statements or conduct of any third party on this service
(5) Any other matter relating to the Premium Members Service.
This Agreement shall form the agreement between Premium Members and Your Poetry Dot Com and supersedes any prior agreements, it may not be modified orally, and it may not be assigned by either party without the other's written consent. Such consent may not be unreasonably withheld. The Agreement shall be governed by the laws of Australia, and any attempt to enforce this Agreement shall be brought in Townsville, Queensland, Australia only. The failure or delay by either party to exercise any right, power or remedy under this Agreement shall not operate as a waiver of any such right, power or remedy.
